:Respondents Prayer: This Petition is filed under Section 482 of Criminal Procedure Code to direct the 2nd respondent not to harass the petitioner on the guise of enquiry except under due process of law and based on the representation of the petitioner dated 19.07.2019.

O R D E R

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner.

2. According to the petitioner, the petitioner's brother namely, Jose Ananth Singh is an accused in a murder case. At the time of the alleged occurrence, the petitioner was in abroad and he is not aware of the said occurrence. Now under the guise of conducting investigation on the above said murder case, the second respondent police is harassing the petitioner. Hence, the petitioner has filed the present petition.

3.The learned Government Advocate (Crl.Side), on instructions, would submit that the petitioner's brother is an accused in a murder case and he is absconding for the past three years. The https://hcservices.ecourts.gov.in/hcservices/

second respondent is conducting enquiry only in order to find out the whereabouts of the accused / brother of the petitioner. He would further submit that the respondent police has not harassed the petitioner and nor intent to harass him.

4. Considering the fact that the respondent police is only conducting enquiry with regard to a murder case, in which the petitioner's brother is involved, the petitioner is directed to cooperate with the enquiry. Further, the respondent police is directed not to harass the petitioner under the guise of enquiry.

5. With this direction, this Criminal Original Petition is disposed of.
