ORDER

This Writ Petition is filed seeking to to issue a Writ of Mandamus directing the 2nd respondent to take necessary action as against the private respondents No. 3 to 5 and conduct enquiry in connection with petition acknowledgment slip dated 19.11.2025 in Ref. No. / PET/SPTRI/2025 and conclude the same by considering the petitioner's complaint dated 19.11.2025 within the time frame as fixed by this Court.

2. Since, no adverse order is proposed to be passed against the respondents 3 to 5, in this writ petition, notice to them is dispensed with.

3. The learned counsel for the petitioner submitted that the private respondents approached him during the month of May, 2022, explaining 2/6

that they were doing business of purchasing auctioned jewelry and resale. Allured by their words, the petitioner was prompted to invest in that business, following which he had given an amount of Rs.25,00,000/- to them in cash. On the very next month, the private respondents gave the 3% of profit and demanded further amount of Rs.38,80,000/- in the month of July 2022, pursuant to which the petitioner had also given a further amount of Rs.14,00,000/- by pledging jewellery. Totally, a sum of Rs.1,20,00,000/- has been invested by the petitioner. Later, the petitioner came to understand that he has been cheated by the private respondents and all the amount has been swindled. In this regard, in due course of time, indiscrepancies crept in between the petitioner as well as the 4th and 5th respondents in proportionately disbursing the profits obtained in the auction business. The petitioner has given a complaint before the respondent police. No action was taken and hence this writ petition.

4. The learned Government Advocate submitted that already a complaint has been received as against the petitioner and the private respondents regarding obtaining investment money from one Thaha Mohamed and further for deceiving the said Thaha Mohamed by not 3/6

giving the profit amount to the said victim. in this regard a first information report in Crime No.24 of 2025, has been registered on 11/6/2025 in which the petitioner is arrayed as third accused, the 4th respondent is arrayed as 5th accused and the 5th respondent is arrayed as first accused.

5. Heard either sides and carefully perused the materials available on record.

From the submissions made by either sides and on careful perusal of the first information report mentioned by the learned Government Advocate, it is seen that it is a business dispute which had between the petitioner as well as the respondents and some other investors. In that business transaction, already a criminal case has been registered as against the petitioner and it is needless to state that only to escape from the clutches of the law, the petitioner has come before this Court by way of this petition.

7. Therefore, I do not find any merit in this writ petition. Therefore, this Writ Petition is hereby dismissed in limine at the time of admission itself.
