Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent i.e., Secretary to Government, Revenue Department, Chennai, to send the pension proposals of the petitioner to the Accountant General, Chennai within a specified time frame that may be fixed by this Court.

When the matter is taken up for hearing, it is represented by the learned counsel for the respondent that the petitioner has made a representation to the respondents and that the respondent concerned may be directed to forward a pension proposal to the authorities concerned if there are no legal hurdles. submitted that there is no objection in considering the entire period of service into account for the purpose of calculating pensionary benefits if otherwise he is eligible and if so, he may be granted pensionary benefits within a time limit. It is stated by the respondent that the contentions doesn't mean that they have admitted the claim of the petitioner.

2.In view of the said submission, the petitioner's eligible service would be taken into account for the purpose of calculating pension, if there are no legal impediment and if the same is in accordance with law. Such exercise shall be done by the authorities concerned within a period of two months from the date of receipt of a copy of this order. The Writ petition is disposed of accordingly. No costs.
