Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus direct the respondents to consider the petitioner's representation dated 30.06.2016 and issue Patta to the petitioner's name bearing S.No.301/2A6 at Pappakudi Village No.II, Tirunelveli District to the extent of 0.22.0 and along with 7.5 HP Well and the electric motor bearing electricity connection No.A20 and subsequently it is converted as digital No.070-63-02120 in the light of Assistant Commissioner (Land Reforms), Tirunelveli vide Na.Ka.No.A2/424/2014 dated 11.09.2014. ORDER

The petitioner has filed this Writ Petition seeking a direction, directing the respondents to consider his representation dated 30.06.2016 and issue patta to him in respect of the property bearing S.No.301/2A6 at Pappakudi Village No.II, Tirunelveli District, in the light of report of the Assistant Commissioner (Land Reforms), Tirunelveli vide Na.Ka.No.A2/424/2014 dated 11.09.2014.

2.According to the petitioner, he purchased a property from one Amarnath Prabhakar and his family members by means of a registered sale deed dated 21.09.2015. After purchase, on 30.06.2016, the petitioner filed an application before the third respondent/Tahsildar, Cheranmahadevi Taluk for transfer of patta. But the third respondent, did not consider the same till date. Hence, he has filed the present writ petition. 3.Heard the submissions made on either side and perused the documents carefully.

4.Since the petitioner's application for transfer of patta is pending before the third respondent/Tahsildar, Cheranmahadevi Taluk, the third respondent is directed to consider the application of the petitioner, dated 30.06.2016, on merits and in accordance with law, after issuing notice to the petitioner and the rival claimants, if any, within a period of 8 weeks from the date of receipt of a copy of this order.

5.With the above direction, the writ petition is disposed of. There shall be no order as to costs.
