Respondent/Appellant/ Respondent/Defendant Prayer :- This Civil Revision Petition filed under Article 227 of the Constitution of India to set aside the executable and fair order dated 08.03.2021 passed in C.M.A No. 2 of 2018 on the file of the Principal Sub Court, Srivilliputhur reversing the executable and fair order dated 01.07.2015 passed in I.A.No 1186 of 2014 in O.S. No. 216 of 2014 on the file of the Additional District Munsif, Srivilliputhur and pass such other suitable orders and thus render justice.
ORDER:- This Civil Revision Petition coming on for hearing on this day under the caption "Extension of time for Lower Court" and upon perusing the earlier orders of 1/4
this Court dated 05.04.2022 and the requisition letter submitted by the District Munsif, Rajapalayam, forward by Principal District Judge, Virudhunagar at Srivilliputtur vide in letter D.No.10725 dated 06.11.2023, this Court made the following order:
Today, this case is listed under the caption for "Extension of Time for Lower Court".
2. It is evident from the records that this Court, vide order dated 05.04.2022, directed the Additional District Munsif Court, Srivilliputhur, to dispose of the suit in O.S.No.216 of 2014, within a period of six months from the date of receipt of copy of that order. Subsequently, at the request of the learned District Munsif, Rajapalayam, three months further time was granted, vide order dated 27.06.2023.
3. Now the learned District Munsif, Rajapalayam, has submitted a requisition dated 01.11.2023 through the learned Principal District Judge, Virudhunagar District at Srivilliputtur, stating that the case is pending for the plaintiff's side further evidence and seeks three months further time.
4. Since this Court has already granted nine months time and also taking note 2/4
of the fact that the suit is pending from 2014, the learned District Munsif, Rajapalayam, is hereby directed to complete the trial and dispose of the suit in O.S.No.216 of 2014 within a period of two months from the date of receipt of copy of this order.
