PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.161 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS, 2023 r/w. Section 21

(4) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.161 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused illegally transported one unit of oorani sand using a tractor with trailer. Hence, the present case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. He has been arrayed as an accused solely based on the confession of the co-accused. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/4

4. The learned Government Advocate (Criminal Side) submitted that the petitioner has been arrayed as A3. A1 and A2 were arrested and are still in custody. Based on the confession of the co-accused, the petitioner has been implicated in this case. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and also taking note of the fact that the co-accused have been arrested and are still in custody, and that the FIR was registered on 13.06.2025 and the case is at the initial stage of investigation, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
