ORDER
The petitioners, who are A1 & A2 in Cr.No.02 of 2022 on the file of the first respondent Police, have filed this petition to quash the said proceedings.
2.The learned Government Advocate(Crl.side) appearing for the first respondent submits that the petitioners have collected money in the guise of chit company, without any authority and they have cheated the second respondent and others. Based on the complaint lodged by the second respondent, a case in Cr.No.02 of 2022 has been registered as against the petitioners, for the offence under Section 420 IPC r/w Sections 4(1) & 76(1) of the Chit Funds Act. Further, he submits that the investigation is almost completed and they are going to file the final report, through E.Filing within a week.
3.Recording the above submission that the investigation has already been completed, this criminal original petition is dismissed with a direction to the first respondent Police to file the final report within one 2/4
week from the date of receipt of a copy of this order. The petitioners shall workout their remedy by challenging the final report. Mere filing of final report through E-filing is not enough. It is the duty of the first respondent Police to ensure that the final report is taken on file, within a reasonable time. Consequently, connected miscellaneous petition is closed.
