Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to grant building permission for the change of use of the petitioner's building in Door No.7B, Survey No.225/1C, Ward No.51, Kamarajar Salai, Madurai in accordance with the Section 63-B of the Tamil Nadu Town and Country Planning Act, 1971 within the time period stipulated by this Court.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondent to give necessary permission to change use of the building which is in existence in Door No.7B, Survey No.225/1C, Ward No.51, Kamarajar Salai, Madurai, in accordance with the provisions of Section 63-B of the Tamil Nadu Town and Country Planning Act, 1971, by way of issuing a writ of mandamus.

2.Mr.R.Prabhu Ramachandran, learned counsel, has taken notice for the respondent.

3.It is seen from the records that on 27.03.2017, a representation has been given, but the respondent has not considered the same and therefore this Court is inclined to pass the following order.

4.In fine, this writ petition is allowed in part without costs and the respondent is directed to look into the representation dated 27.03.2017 alleged to have been given by the petitioner and dispose of the same within a period of one month.
