Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 2 and 3 to take necessary and appropriate action based upon the representation dated 10.11.2016 within a stipulated time as fixed by this Court. ORDER
[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 2 and 3 to consider the representation dated 10.11.2016 alleged to have been given by the petitioner, by way of issuing a writ of mandamus. 2.Mr.M.Govindan, learned Special Government Pleader, has taken notice for the respondents.
3.The petitioner is present and contended to the effect that a First Information Report has been registered against four persons, but the period mentioned in the First Information Report does not cover the period mentioned in the representation dated 10.11.2016.
4.The learned Special Government Pleader appearing for the respondents has contended to the effect that since on the basis of representation given by the petitioner, a First Information Report has been registered in Crime No.5 of 2015, the Investigating Agency has to be impleaded in the present writ petition. 5.The main grievance expressed on the side of the petitioner is that so many irregularities have been done in laying road at the cost of Rs.51 lakhs. Further in the First Information Report, the period pointed out by the petitioner has not been covered.
6.Considering the grievance expressed on the side of the petitioner and also considering the fact that the First Information Report has been registered in respect of the period from the year 2009 to 2013 and the definite stand taken on the side of the petitioner is that no case has been registered in respect of the subsequent period, this Court is inclined to pass the following order.
7.In fine, the petitioner is directed to give a representation to the Vigilance and Anti Corruption Wing, Virudhunagar and the same should be considered and disposed of within a period of one month from the date of receipt of such representation. With the above observation, this writ petition is disposed of. No costs.
