ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the official respondents to survey the property of the petitioner situated at Kottur Village, Nilakottai Taluk, Dindigul District, in Survey No.146/3 measuring an extent of 0-21.50 acres, by considering the petitioner's online representation dated 07.08.2025.

2. The petitioner is claiming right over the property comprised in Survey No.146/3, measuring an extent of 0.21.50 acres. The said property originally belonged to the petitioner's husband, namely, Murugesan. Thereafter, Murugesan settled the property in favour of the petitioner through a registered Settlement Deed dated 23.07.2024. However, the fourth respondent, who is the brother of the petitioner's father-in-law occupied the said place and is preventing the petitioner from entering the property. Therefore, the petitioner is seeking to survey the subject property.

3. In view of the above, the third respondent is directed to conduct a survey based on the petitioner's online application, after reaching notice to the petitioner as well as the fourth respondent. If the third respondents requires police protection, the same shall be provided by the jurisdictional police. According to the petitioner, the fourth respondent is in possession of the property. The fourth respondent cannot be dispossessed under the guise of survey. The petitioner shall follow due process of law and shall not take the law into her own hands or create any law and order problem. In case of the petitioner is intended to evict the fourth respondent, she is at liberty to work out her remedies before the competent Civil Court. The official respondents shall adhere to the following Standard Operating Procedures:

• The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 3/5

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
