Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the 1st respondent to take necessary action for confirming the draft scheme dated 29.01.2026 issued in O.A.No.40/2023 in respect of Arulmigu Achuwandi Parai Perumal Temple, Pambalupatti, Gujiliamparai Taluk, Koombur Village, Dindigul District on the basis of the petitioner representation dated 11.5.2026 and to pass such other further order or orders as this Honorable court may deem fit and proper in the circumstances of the case and thus render justice. ORDER

The writ petition is filed for a mandamus directing the 1st respondent to take necessary action for confirming the draft scheme dated 29.01.2026 issued in O.A.No.40/2023 in respect of Arulmigu Achuwandi Parai Perumal Temple, Pambalupatti, Gujiliamparai Taluk, Koombur Village, Dindigul District on the basis of the petitioner representation dated 11.5.2026 and to pass such other further order or orders as this Honorable court may deem fit and proper in the circumstances of the case and thus render justice.

2. Heard Mr.R.G.Shankar Ganesh, learned counsel appearing for the petitioners and Mr.S.Vashik Ali, learned Government Standing Counsel who takes notice on behalf of the respondents 1 and 2.

3. The learned counsel appearing for the petitioners would submit that Framing of scheme, Rules published by G.O. (Ms.) No. 4851 dated 26.11.1960, as amended periodically are applicable for the purpose of framing the scheme. The time granted for any person to file objections to the draft scheme is only 60 days.

4. In this case, the draft scheme was published as early as January, and the 60-day period for filing objections has also expired. Even thereafter, the respondents have not passed final orders in respect of the same.

5. In view of the nature of the order passed, the writ petition is disposed of at the admission stage without notice to the private respondents. This Court is not expressing any opinion on the merits of the case.

6. When the draft scheme is said to have been published on 29.01.2026, it is for the 1st respondent to pass the final orders in accordance with the rules by considering the objections, if any, and by hearing all the parties concerned. The said exercise shall be completed as expeditiously as possible, in any event not later than four months from the date of receipt of the web copy of this order.

7. With these directions and observations, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
