Prayer :- Criminal Original Petition filed under Section 439 of Criminal Procedure Code, praying this Court to grant bail to the petitioner/Accused No.3 in connection with Crime No. 2 of 2020 pending on the file of the respondent Police. ORDER:- Criminal Original Petition coming upon for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.V.Om Prakash, Advocate for the Petitioner and of M/s.M.Ananthadevi, Government Advocate (Criminal Side) on behalf of the Respondent, this Court made the following order:

The learned Government Advocate (Crl. Side) made a submission that totally 15 accused are involved in the alleged misappropriation of public funds to the tune of Rs.5,27,05,950/-. The petitioner is the third accused and the other accused are absconding. The Managing Director is the close relative of the petitioner/3rd accused.

2.This Court is able to draw an inference that the respondent police is not acting strictly, despite the fact that the huge public money is involved in this case. More than 66 victims have given complaint and any delay would cause greater prejudice to the interest of the investors in the matter of recovering the money from the accused persons or from the persons concerned. This being the urgency, the inaction by the respondent police is to be viewed seriously.
