Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records pertaining to the impugned notice issued by the 1st respondent in his proceedings in Na.Ka.No.2825/U/2024 dated 02.07.2024 and quash the same as illegal.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned notice issued by the 1st respondent in his proceedings in Na.Ka.No.2825/U/2024 dated 02.07.2024.

2.Even though the impugned notice is a notice, the same is issued under Section 77(A). The official respondents cannot invoke Section 77(A) since the same is held ultra vires.

3.Therefore, the impugned notice is quashed. If the parties are aggrieved regarding their title, they are at liberty to approach the competent Civil Court. 4.The learned Counsel appearing for the 3rd respondent submitted that 2 FIRs are filed against the petitioner. This Court is not expressing any opinion about the against the FIRs and the same may be dealt with as per criminal laws. 5.With the above observations, this Writ Petition is allowed.
