ORDER : The Court Made the following order :- The petitioner is in judicial custody since 13.09.2018 for the offence punishable under Sections 294(b), 342,324,506(ii), 379 and 307 of IPC, in Crime No.255 of 2018 on the file of the respondent police. He Seeks bail.

2. The case of the prosecution is that the victim had parked his car near a bakery. At that point of time there was a wordy quarrel between the victim and the accused persons and the accused persons are said to have assaulted the victim. This incident had taken place on 10.09.2018. The injury sustained by the victim are simple injuries.

3. The learned counsel for the petitioner would submit that there are totally four accused persons in this case and already A1, A3 and A4 were granted anticipatory bail. He would further submit that this petitioner has been falsely implicated in this case and the petitioner has been in jail from 13.09.2018 onwards.. Hence, he prays for grant of bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that there are previous cases against the petitioner. Therefore he vehemently opposed grant of bail to this petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the above facts and circumstances of the case and that A1,3 and 4 have been already released on bail and this petitioner is arrayed as A2 and he is in confinement from 13.09.2018, this court deems it fit to consider the bail application by imposing certain stringent conditions against the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Ramanathapuram (ii)the petitioner shall appear before the respondent police daily at10.30 a.m and 5.30 p.m. until further orders; sd/- 05/10/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
