ORDER
The petitioner claims that he is constructing a temple in his patta land. With a grievance that one Perumal @ Vallan is obstructing the said construction, he has submitted an application before the respondent police seeking police protection and has filed this petition. 2.Mr.K.S.Kathiravan, learned Counsel represents before this Court that the petitioner has not made the said Perumal @ Vallan as a party to this writ petition. According to him the petitioner is attempting to construct a house in the land of Vallan and he is having a decree in his favour passed by the Sub Court, Manapparai in AS.No.7 of 2019, dated 01.04.2024.
3.The learned Additional Public Prosecutor appearing for the respondent police submits that since the issue is with regard to construction of a temple in a land, over which both parties claim title, they have to work out their remedy before the civil Court. 2/4
4.This Court considered the rival submissions made. 5.If the petitioner is having right over the land, where he is constructing the temple and if the third party is objecting for the same, the petitioner has to work out his remedy only before the civil court and therefore, this Court is not inclined to grant any relief as sought for by the petitioner.
