ORDER
The petitioner has filed this petition seeking a direction to the first and second respondents to provide adequate police protection for constructing solar power plant at Mudukkalamkulam village, Kayathar Taluk, Tirunelveli District by considering the petitioner's representation dated 07.06.2025 and 09.06.2025 within a time frame. 2.The petitioner, who is the Manager in Speed Boomi Promoters LLP private limited company, has filed this petition that the petitioner's company had purchased 130 acres land in Mudukkalamkulam village, Kayathar Taluk, Tirunelveli District, for the purpose of establishing solar power plant. However, the petitioner was prevented from installing the solar power plant in his own land by some of the miscreants in the village. The private respondents herein and their hooligans have demanded money from the petitioner. Therefore, the petitioner lodged a complaint before the 2/6
respondent Police on 07.06.2025 and 09.06.2025. Since there is no action, the petitioner is before this Court.
3.The learned Government Advocate(Crl.side) appearing for the respondents 1 & 2 submits that since there is a dispute between the petitioner and the private respondents, they have referred the matter to the Revenue Divisional Officer and the Revenue Divisional Officer has also conducted a peace committee meeting.
4.The learned counsel appearing for the respondents 3 & 4 submits that one Ramasubbu and the respondents 3 & 4 are the cultivating tenant of the land, which has been purchased by the petitioner. Further, they are also having patta with regard to some of the properties. The said Ramasubbu has also filed a suit in O.S.No.118 of 2025 and the same is pending before the Principal District Court, Thoothukudi.
5.This Court has considered the submissions made on either side and perused the available records.

6.The petitioner claims that he is the owner of the property, which was purchased with an intention to install solar power plant. The private respondents are raising certain issues that they are cultivating tenants. If they are cultivating tenants,they would have been registered under the Tenancy Act. The respondent Police are not justified in referring the matter to the Revenue Divisional Officer. In the event, of the petitioner is having valid registered sale deed, if anybody is obstructing this petitioner from utilising his land, it is the responsibility of the respondent Police to provide adequate Police protection.
7.In this case, it appears that this petitioner has purchased the land for the purpose of installing a solar power plant and he has been prevented by the private respondents. The private respondents also claim that they are having patta for the same. In that event, if the private respondents are having certain title over the property, they have to work out the remedy before the civil Court and they cannot take the law into their hands by preventing the petitioner from installing the solar power plant. It is the duty of the respondent Police to take necessary action as against the persons, 4/6
whoever, take the law into their hands and prevent anybody from utilising his property.
8.With the above observations, this writ petition is disposed of with a direction to the respondent Police to provide Police protection to the petitioner to install solar power plant. No costs. 06.08.2025 gns To 1.The Superintendent of Police, Tirunelveli District, Tirunelveli.
