Heard the learned counsel on either side.

2.The petitioner seeks removal of a tamarind tree standing near the petitioner's house. The tree stands only on government land. The petitioner apprehends that the roots of the tree may cause damage to his house in future. The petitioner has to invoke the common law remedy of filing civil suit. The writ petition will not lie.
