ORDER

The petitioner is the defacto complainant in Crime No.371 of 2024. The said case was registered for the murder of the petitioner's son Rajendra Prasath. The petitioner, a widow, is living with her two sons and daughter. As per the petitioner's complaint, the accused in Crime 1/6

No.371 of 2024 is having illegal intimacy with one Mahalakshmi, which was objected by the petitioner and one Shanmugaraja, the brother of the said Mahalakshmi. Thereafter, the accused, under the guise of compromise, took the petitioner's son Rajendra Prasath on the fateful day and murdered him. Therefore, a case in Crime No.371 of 2024 was registered for the offences under Sections 296(b), 151(2), 103 and 351(3) of BNS and after investigation, a final report was also filed before the learned Judicial Magistrate No.VI, Madurai in PRC No.440 of 2024 and the same was committed to the Court of Session and now, the case is pending before the I Additional District and Sessions Court, Madurai, in S.C.No.738 of 2024. In these circumstances, the petitioner has lodged a complaint that the accused in Crime No.371 of 2009, namely, Karthick Raja, is posing a threat and compelling her to withdraw the case. Therefore, the petitioner has moved this petition seeking a direction to the trial Court to conclude the trial in S.C.No.738 of 2024.

2. Considering the submissions of the petitioner, this Court, by its earlier order dated 19.06.2025, directed the respondent Police to ascertain the genuineness of the petitioner's complaint and find out 2/6

whether any real threat has been posed to the petitioner.

Pursuant to the direction of this Court, the Inspector of Police, Thirupparankundram Police Station, has filed a status report that the accused Karthick Raja was already arrested in Crime No.143 of 2025 for the offences under Sections 331(3), 331(4) and 305 of BNS (Battery theft in cell phone tower) and they have remanded him to judicial custody on 08.01.2025. According to the Inspector of Police, Thirupparankundram, the accused Karthick Raja is still in custody. The Inspector of Police further states that the said Karthick Raja did not threaten the defacto complainant in Crime No.371 of 2024 for tampering the witnesses. However, even according to the complaint of the petitioner, an unknown woman, aged about 50 years, met her at the Thirupparankundram City Bus Stop and asked her to drop the case in view of the life of the accused and his age. But, the petitioner refused and moved away. Thereafter, no one approached the petitioner to withdraw the case.

5. It appears that there was an incident either to threaten or coerce her to drop the case in Crime No.371 of 2024. The learned Government Advocate (Crl. Side) submits that the case is now posted on 04.08.2025 for appearance of the accused.

6. Therefore, the respondent Police is directed to provide police protection to the petitioner under the victim protection scheme. The trial Court shall also endeavour to conclude the trial in S.C.No.738 of 2024 as expeditiously as possible. Whenever the summons are issued by the trial Court, the respondent Police are directed to produce the witnesses on that day, without fail.

7. With the above direction, this Criminal Original Petition is disposed of.
