Heard the learned counsel on either side.
2. When the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondent submitted that a case in C.C.No.118 of 2022 is pending against the petitioner before the Judicial Magistrate Court, Valliyoor. Hence the petitioner has to necessarily moved the jurisdictional Magistrate Court for the relief.
3. As and when the petitioner files Miscellaneous Petition seeking the relief now sought before the concerned Magistrate Court, the learned Magistrate shall dispose of the same on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.
4. With this liberty to the writ petitioner and the direction to the learned trial Magistrate, this Writ Petition is disposed of.
