Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the first respondent to grant 21 day Ordinary Leave without police escort to the petitioner`s husband namely Rajendran, S/o. Durairaj, aged about 46 years, life convict, PID No.161920, confined at Central Prison, Trichy on the basis of the petitioner's representation dated 26.03.2026. O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed for the issue of writ of mandamus directing the first respondent to consider the representation made by the petitioner on 26.03.2026 and to grant 21 days ordinary leave without police escort to the petitioner's husband, who is presently serving sentence at Central Prison, Trichy.

2. Heard the learned counsel on either side.

3.The petitioner's husband is a life convict and is presently serving sentence at Central Prison, Trichy. A representation was made by the petitioner seeking for ordinary leave on the ground that the convict's mother is suffering from heart ailments and financial arrangements must be made for the treatment.

4. When the matter was taken up for hearing, the learned counsel for the State of Tamil Nadu (Criminal Side) submitted that the representation was considered and through proceedings dated 03.06.2026, the first respondent has granted 21 days ordinary leave with police escort.

5. Taking into consideration the facts and circumstances of the case and the reason for which the ordinary leave has been sought for and taking note of the order passed by the first respondent dated 03.06.2026, we are inclined to modify the condition imposed by the first respondent and instead of police escort, there shall be a direction to the convict to report before the fourth respondent Police daily at 05.00 p.m., during the entire ordinary leave period and the sureties will be furnished by the convict before the Jail authorities. The other conditions imposed by the first respondent shall stand as it is.
