ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned refusal check slip dated 03.06.2025 vide refusal No.RFL/Thirupparankundram/3/2025 passed by the 3rd respondent and consequently, to direct the 3rd respondent to register the Deed of General power of Attorney presented by the petitioner. 2.It is seen from the refusal slip that the parties were not present in person. One of the conditions to register itself is that both the parties should appear before the Registering Officer in order to identify the parties. If they had not appeared, the respondents are absolutely right in refusing to register the document. Further, the petitioner is seeking to validate the unregistered partition deed through the Power of Attorney which cannot be done. Therefore, the refusal slip is absolutely right.

3.This Court is not inclined to quash the refusal slip. However, the petitioner is at liberty to resubmit the document as per law. If the document is in accordance to law, the respondents shall consider the same as per law. 2/4

4.With the above observations, this Writ Petition is disposed of . There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
