O R D E R

This petition has been filed to direct the learned Special Court (PCR Act Cases), Ramanathapuram to consider the bail application of the petitioner concerned Crime No.407 of 2021 on the file of the Inspector of Police, Paramakudi Town Police Station, Ramanathapuram District/the second respondent herein and pass orders in accordance with law on the same day on his surrender if any petition filed by the petitioner.

2. This is the second petition for the very same relief. Earlier petition filed by this petitioner came to be dismissed on 01.09.2021 in Crl.O.P.(MD).No.11696 of 2021 on the ground that the petitioner is involved in four previous cases, among which, Section https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.13628 of 2021 307 of IPC is also pending.

3. When the matter is taken up for hearing today (I.e.,) 16.09.2021, the learned counsel for the petitioner would submit that the defacto complainant is a rowdy element and against him also, a case is pending. On that ground, this petition has been filed.

4. But the antecedents of the defacto complainant cannot be a matter for consideration in this matter. Only the antecedents and the conduct of the petitioner are the relevant.

5. Since the petitioner is involved in four previous cases, in which Section 307 of IPC is one, this Court is not inclined to consider this petition. Hence, this Criminal Original Petition is dismissed.
