PRAYER :- For Bail in Crime No.278 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioners/ accused herein, who were arrested on 15.07.2022 for the alleged offences under Sections 272, 273, 328 IPC and 24(1) of COTP act, 2003, in Crime No.278 of 2022 on the file of the respondent police, seek bail.

2.The case of the prosecution is that when the defacto complainant was on patrol duty, the petitioners are said to have found in possession of prohibited tobacco products. Hence the complaint.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner is not having any previous case and the investigation of the case is pending. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.13781 of 2022 5.Considering the facts and circumstances of the case and also considering the fact that the petitioner is not having any previous case, this Court is inclined to grant bail to the petitioners with certain conditions.

6.Accordingly, the petitioners are ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Sivagangai, Sivagangai District, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
