O R D E R
Heard the learned counsel on either side.
2. The writ petitioner Thiru.T.Suresh Gounder as well as the respondents, namely, Thiru.N.Singaram, Thiru.Durairaj and Thiru.Chandrasekar are present in person before this Court.
3. The issue relates to the performance of the petition mentioned festival. A peace committee meeting was convened by the Revenue Divisional Officer, Iluppur on 19.04.2022. The private respondents, namely, Thiru.N.Singaram, Thiru.Durairaj and Thiru.Chandrasekar are willing to abide by the decision taken in the said meeting. They state that in the year 2025, Thiru.Suresh Gounder can very well conduct the temple festival and during the said temple festival, the idol 2/5
3 W.P.(MD)NO.16813 OF 2022 made by him can be taken inside the temple and that no idol belonging to the private respondents will be taken inside the temple during the said year. The said undertaking given by respondents 3 to 5 is recorded.
4. It is also stated that the petitioner can very well participate in the temple festival and offer his worship. The objections from the private respondents is only regarding the taking of the petitioner's idol inside the temple for the current year. Except recording the undertaking given by the private respondents regarding the conduct of the 2025 festival and also taking into account the fact that the petitioner can very well participate in the current year festival and offer his worship, no other direction can be given in the writ petition.
5. It is stated that the petitioner had already filed a petition under Section 63(e) of THE TAMIL NADU HINDU RELIGIOUS AND CHARITABLE ENDOWMENTS ACT before the Joint Commissioner, Thanjavur. The jurisdictional Commissioner is directed to number the said petition and dispose of it on merits and in accordance with law within a 3/5
