PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondent to consider the petitioner's representation, dated 19.10.2020, within a time stipulated by this Court.

This writ petition is filed for issuance of a writ of Mandamus, to direct the respondent to consider the petitioner's representation, dated 19.10.2020, within a time stipulated by this Court.

2. According to the petitioner, the land situated survey nos.633, 663/1, 453/2 in Thenkarai Village, Vembakottai Taluk, Virudhunagar 2/6

District and survey no.708/7 in A.Lakshmiyapuram Village, belongs to his ancestors, for which the petitioner had relied on the entries in SLR Register. The petitioner submitted the extract of SLR register granted by the respondents and the same was issued on 06.10.2020, wherein it states that the property is still in the name of the petitioner's ancestors. Therefore, the petitioner is seeking to register the said property in his name.

3. However the respondents submitted that the Sub Registrar cannot register the document unless patta is issued in the name of the petitioner.

4. Therefore, the petitioner is directed to approach the District Collector, Virudhunagar. The District Collector is directed to consider the case of the petitioner based on the SLR register and issue Patta in the name of the petitioner. Based on the said Patta, the petitioner shall approach the respondents for registration.

5. With the above said observation, the writ petition is disposed of. No costs.
