Respondent PRAYER :- Criminal Miscellaneous Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 to modify the order dated 28.04.2025 in Crl.OP(MD).No.5370 of 2025 (Condition Nos.3 & 4 ), by reducing the deposit amount of Rs.1,44,360/- to a lesser reasonable sum and permitting the petitioner to appear and sign before the Hosur Town Police Station or any other station in Hosur, Krishnagiri District as may be directed, instead of the police station in Madurai. Mr.S.Prakash, Government Advocate (Criminal Side) ORDER : The Court made the following order :- This petition has been filed for modification of the conditions Nos.7(iii) & (iv) imposed on the petitioner in Crl.OP(MD).No.5370 of 2025 dated 28.04.2025.
2. The learned counsel for the petitioner submitted that the petitioner is from poor family and due to financial crisis, she unable to arrange the amount. He further submitted that the petitioner has been complying with the condition No.7(iv) imposed by this court and he prays for modification of the said conditions.
3. The learned Government Advocate (Criminal Side) submitted that the petitioner has been complying with the condition No.7(iv) regularly.
4. Being satisfied with the reasons stated by the petitioner and considering the nature of offence, the condition Nos.7(iii) & (iv) imposed by this Court in Crl.OP (MD).No.5370 of 2025 dated 28.04.2025, is modified as follows:- ''7 (iii) The petitioner shall deposit a sum of Rs.50,000/-(Rupees Fifty Thousand) to the credit of Crime No.5 of 2024 before the learned Judicial Magistrate No.1 Madurai within a period of two weeks from the date of receipt of a copy of this order and another sum of Rs.50,000/-(Rupees Fifty Thousand) within two weeks thereafter and 2/4
another sum of Rs.44,360/-(Rupees Forty Four Thousand and Three Hundred and Sixty ) within two weeks thereafter. After receipt of entire amount of Rs.1,44,360/-, the learned Judicial Magistrate shall deposit the said amount in an interest bearing Fixed Deposit in any nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.5 of 2024. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment.
7(iv) The petitioner shall appear before the Inspector of Police, Hosur Town Police Station, weekly twice ie., on every Sunday and Monday at 09.00 a.m., until further orders.''
5. Accordingly, this Criminal Miscellaneous Petition is allowed. No costs.
