ORDER

This petition has been filed seeking a direction to the respondents 1 and 2 to take necessary action based on petitioner's representation dated 28.04.2026 within a stipulated time that may be fixed by this Court.

The learned counsel for the petitioner submitted that, owing to matrimonial disputes between the petitioner and her husband, who is serving in the Army, the petitioner was subjected to severe domestic violence whenever he visited home during his leave period. In this regard, the petitioner lodged a complaint before the second respondent police on 28.04.2026. However, no action was taken on the said complaint, and therefore, the petitioner has approached this Court seeking appropriate relief.

3. However, the learned Government Advocate, upon instructions, submitted that an enquiry had already been conducted by the respondent police and the complaint was subsequently closed, as the parties had expressed their intention to seek appropriate relief before the Family Court. 2/4

Per contra, the learned counsel for the petitioner submitted that the petitioner's jewellery weighing about 40 sovereigns and silver articles valued at approximately Rs. 7,00,000/- have not yet been returned. It was further contended that the parties are already estranged, and therefore, a detailed investigation is warranted in the interest of justice.

5. In view of the above, the petitioner is directed to forthwith lodge a complaint before the Inspector of Police, All Women Police Station, Vilathikulam, Thoothukudi District, who is suo motu impleaded as the third respondent. The Registry is directed to carry out the necessary amendments. Mr. P. Vetrivel, learned counsel for the State of Tamil Nadu, takes notice for the third respondent. The third respondent, upon receipt of the complaint from the petitioner, shall issue notice to the petitioner's husband under Section 64 of the BNSS and conclude the enquiry as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
