BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 05.10.2018

CORAM:

THE HONOURABLE MR.JUSTICE V.PARTHIBAN W.P.(MD) No.20936 of 2018 A.Rethinasamy ... Petitioner vs.

1.The District Collector Tiruchirappalli 620001 2.The Revenue Divisional Officer Tiruchirappalli 620001 ... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the 2nd respondent herein to consider the petitioner's representation dated 07.05.2018 and cancel the patta issued in favour of N.Balasubramaniyan.

For Petitioner :

Mr.C.Selvaraj For Respondents :

Mr.S.Angappan Government Advocate (Civil Side)

O R D E R

From the pleadings and the materials as disclosed in the writ petition, this Court does not find any cause of action for entertaining the writ petition. Moreover, the prayer, as sought in this writ petition, is to cancel the so-called Patta granted in favour of one Balasubramaniyan, who is admittedly not made as a party in the writ petition. From the averments it could not be deduced as to when such a Patta was issued to the said Balasubramaniyan. The entire affidavit is bereft of any specific details insofar as the so-called grievance projected in this writ petition.

2. For the above said reasons, this Court is of the view that the writ petition, as it is, is not maintainable both on merits as well as on the ground of non-joinder of necessary parties and the writ petition is, therefore, dismissed.
