J U D G M E N T
(Made by R.VIJAYAKUMAR,J.) The respondents in WP(MD).No.11876 of 2009 have filed the present writ appeal challenging the order dated 08.01.2019 wherein the order of dismissal has been set aside by the writ Court and a direction has been issued to reinstate him and release the terminal benefits. 2.The respondent herein was dismissed from service on 23.11.2007 on the ground that he was involved in a criminal case in C.C.No.39 of 2006. Later, he was convicted in the said criminal case. However, on appeal, by an order dated 29.01.2016, in Criminal Appeal No.78 of 2015, the respondent has been acquitted.
3.Based upon the above acquittal order, the Tahsildar, Elalkudi has recalled the order of dismissal and issued proceedings on 26.09.2019 permitting the respondent to retire from service and for dispersal of retirement benefits.

4.In such view of the matter, nothing survives to be adjudicated in the writ appeal and the writ appeal stands closed. No costs. Consequently, connected miscellaneous petition is closed.
