JUDGMENT

(Judgment of the Court was delivered by Dr.G.JAYACHANDRAN, J.) The writ appeal is filed by the Management challenging the order passed by the learned Single Judge, who has upheld the order passed by the respondents deploying the Physical Education Teacher in the school to the neighboring school. The order of the learned Single Judge referring to the pendency of WP(MD) No.30359 of 2023 challenging the staff fixation by the Chief Educational Officer and disposing of the writ petition stating that deployment of the BT Assistant (Maths) and Physical Education Teacher being identified as surplus cannot be interfered with. Page No.2 of 4

2. If the management is able to succeed in the pending writ petition in WP(MD) No.30359/2023, they can work out their remedy accordingly. We find no reason to interfere with the order of the learned Single Judge. Hence, the writ appeal stands dismissed. No costs. Consequently connected Miscellaneous Petition is closed.
