Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to promote the petitioner to the post of Assistant with effect from 25.09.2012 and to the post of Deputy Block Development Officer with effect from 07.12.2017 with all consequential and monetary benefits by placing the petitioner before his immediate junior by considering the representation of the petitioner dated 18.12.2017 in the light of the proceedings of the Respondent No.1 in G.O.(1D)No.447, Rural Development and Panchayat Raj (Pa-A-4) Department, dated 19.09.2015. The petitioner has come forward with the present Writ Petition for issuance of a Writ of Mandamus, directing the respondents herein to promote the petitioner to the post of Assistant with effect from 25.09.2012 and to the post of Deputy Block Development Officer with effect from 07.12.2017 with all consequential and monetary benefits by placing the petitioner before his immediate junior by considering the representation of the petitioner dated 18.12.2017 in the light of the proceedings of the Respondent No.1 in https://hcservices.ecourts.gov.in/hcservices/
G.O.(1D)No.447, Rural Development and Panchayat Raj (Pa-A-4) Department, dated 19.09.2015 within the stipulated time that may be fixed by this Court.
2. Mr.R.Sethuraman, the learned Special Government Pleader takes notice for the respondents.
3. The learned counsel appearing for the petitioner submitted that it would suffice if the representation of the petitioner, dated 18.12.2017, is disposed of in accordance with law, within a time frame to be fixed by this Court.
4.In view of the limited scope of the prayer, without going into the merits of the matter, the Authority concerned is directed to consider the representation of the petitioner dated 18.12.2017, in accordance with law, after affording an opportunity of hearing to the petitioner, pass appropriate orders within a period of two months from the date of receipt of a copy of this order, if there are no legal impediments.
5.With the above direction, the Writ Petition stands disposed of. No costs.
