: Respondent PRAYER: Criminal Revision Case is filed under Section 397 r/w 401 of Criminal Procedure Code, praying to call for the entire records pertaining to the order passed by the learned Judicial Magistrate, Vadipatti, Madurai District in Crl.M.P.No.3238 of 2018 vide his order dated 19.09.2018 and quash the same and consequently direct the above said learned Judicial Magistrate to return the vehicle namely Tipper lorry bearing registration No.TN 60 J 1499 in connection with the case in Crime No.86 of 2018 pending on the file of the respondent, to the petitioner.

ORDER

There is no representation on behalf of the petitioner. 2.Heard the learned Government Advocate (Crl. Side) appearing for the respondent and perused the records.

3.The application to return the vehicle which has been involved in illegal sand mining was dismissed by the trial Court on the ground that if the vehicle is returned to the petitioner herein, there is every possibility of altering the physical feature of the vehicle as well as make use of the vehicle again for illegal activities.

4.This Court finds no reason to interfere with the said order of the trial Court. Hence, this Criminal Revision Case is dismissed.
