Heard the learned counsel for the petitioner and the learned counsel for the respondents.
2.By consent, the Writ Petition itself is taken up for final disposal.
https://hcservices.ecourts.gov.in/hcservices/ 3.The petitioner has filed an application before the Joint Commissioner, Hindu Religious and Charitable Endowment Department
under Section 34 (c)(2)(1) of the Hindu Religious and Charitable Endowments Act, 1959 and the above application has been rejected by the first respondent. Challenging the same, the present Writ Petition has been filed.
4.Against the order passed under Section 34 (c)(2)(1) of the Hindu Religious and Charitable Endowments Act, 1959, an appeal remedy is provided before the Commissioner, HR & CE Department, under Section 34(c)(5) of the Hindu Religious and Charitable Endowments Act, 1959. Without availing the said appeal remedy, the petitioner cannot approach this Court by way of filing this Writ Petition and hence, the same is not maintainable. 5.In view of the same, this Writ Petition is dismissed. However, liberty is given to the petitioner to challenge the order passed by the first respondent before the Commissioner, HR & CE Department in the manner known to law. No costs. Consequently, connected Miscellaneous Petition is also closed.
