Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of Mandamus forbearing the respondent Corporation from taking any further and coercive steps to collect property tax as demanded to the tune of Rs.12,74,682/- from the petitioner's trust without disposing the request made by the petitioner's trust to give exemption of levying property tax as provided under Section 122(c) of the Madurai City Municipal Corporation Act.

ORDER

On instructions, the learned Senior Counsel appearing for the petitioner seeks permission of this Court to withdraw this writ petition with liberty to file a fresh writ petition in regard to the subject matter of the present writ petition and he has also made an endorsement to that effect.

2. In view of the endorsement so made, the Writ Petition is dismissed as withdrawn with liberty as prayed for. No costs. Consequently, the connected Miscellaneous Petition is also dismissed.
