ORDER : The Court made the following order :- This Petition is filed to release the petitioner / accused on bail in C.C.No.539 of 2008 on the file of the I Additional Special Court for Trial of NDPS Act Cases, Madurai, in Crime No. 48/2006 on the file of the Respondent Police.

2. The petitioner/Accused, who was arrested and remanded to judicial custody on 10.05.2024 for the offences punishable under Section 8(c) r/w. Section 20(b)(ii)(B) of NDPS Act, in crime No. 48/2006 on the file of the respondent police, seeks bail.

3. Earlier the petitioner was granted bail in Crime No.48 of 2006 and in C.C, stage he absconded. After filing charge sheet, as the summon could not be served upon the petitioner, the trial Court, has issued non bailable warrant for appearance and he was arrested on 10.05.2024.

4. Heard the learned counsel on either side and perused the material records of the case.

4. Considering the overall facts and circumstances of the case and also considering the fact that the case is now progressed and is now posted for continuation of the Investigating Officer's evidence, I am of the view that, at this juncture, the petitioner need not be enlarged on bail.

5. Hence, this Petition is dismissed. Considering the fact that the petitioner is in jail, the prosecution is directed to expedite the proceedings and the trial Court is also 2/4
