O R D E R
This writ petition has been filed to quash the impugned proceedings issued by the second respondent dated 21.09.2016 and consequently direct the respondents to provide duty to the petitioner along with back wages.
2.Heard the learned counsel appearing for the petitioner and the learned counsel for the respondents, who takes notice for the respondents. By consent the writ petition itself is taken up for final disposal at the admission stage.
3.The petitioner was initially appointed as a Conductor in the respondents corporation and subsequently his service was regularized by the proceedings dated 22.07.2013. He was suspended from service by the impugned order dated 21.09.2016. Challenging the same, the present Writ Petition has been filed. 4.A perusal of the impugned order dated 21.09.2016 would go to show that the petitioner was suspended from service on the allegation that he trespassed into the computer section, Ponmeni depot and voluntarily plucked the FC trip invoice and ticket books of one conductor viz., Devaraj.
5.In the same proceedings it has been mentioned that charge sheet will be issued later.
6.Therefore, whatever may be the objections of the petitioner, when show cause notice or charge memo is issued, he will have an opportunity of representing his case before the concerned authorities. The second respondent, being a statutory authority, has exercised his power as provided under the statute, which is based upon the allegations made against the petitioner. Therefore, this Court cannot interfere with the order passed by the second respondent.
7.Accordingly, this writ petition is dismissed. However, the respondents are directed to expedite and finish of the enquiry within a period of three months from the date of receipt of a copy of this order. No costs. Consequently, connected WMP(MD)Nos.13615 and 13616 of 2016 are closed.
