No. 25 of 2019 dated. 30.04.2021 on the file of Additional District Court, Sivagangai pending disposal of the above Criminal Revision Petition.

Prayer in CRL RC(MD) No.758 of 2021:

To call for the records relating to the order in C.C.No.156 of 2018 dated 19.03.2019 on the file of the Learned Judicial Magistrate/Fast Track Court, Karaikudi confirming in C.A. No. 25 of 2019 dated. 30.04.2021 on the file of Additional District Court, Sivagangai and to set aside the same and allow this Criminal Revision Petition.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.HEROLD SING S.C. Advocate for the Respondent and none appeared for the petitioner either in person or by an Advocate, the court made the following order:- This petition has been filed by the petitioner to suspend the sentence passed in C.A.No.25 of 2019 before the learned Additional District Judge, Sivagangai on 30.04.2021.

2.While suspending the sentence, the petitioner was directed to deposit 25% of cheque amount, ie., Rs.1,75,000/- to the credit in C.C.No.156 of 2018. The learned counsel for the respondent submitted that as directed by this Court, the petitioner deposited the said sum and seeking permission to withdraw the same. https://hcservices.ecourts.gov.in/hcservices/ 1/2

RL MP(MD) No.8927 of 2021 3.In view of the above, the respondent is permitted to withdraw the amount, which was deposited by the petitioner, by filing separate application before the trial Court.

4.With the above directions, this miscellaneous petition is disposed of.
