PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.140 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 303(1) of BNS, 2023 r/w. Sections 21(1) & 21(4) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.140 of 2025 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the accused illegally excavated river sand using three tractors with trailers and a JCB vehicle. Hence, the present case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and are in no way connected with the alleged occurrence as stated by the prosecution. The petitioners are merely the owners of the vehicles. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioners. 2/4

4. The learned Government Advocate (Criminal Side) submitted that there are totally five accused persons in this case and the petitioners have been arrayed as A4 and A5. A1 to A3 were arrested on 12.06.2025 and are still in custody. Hence, he opposed to grant anticipatory bail to the petitioners.

5. Considering the facts and circumstances of the case, and also taking note of the fact that the co-accused have been arrested and are still in custody, and that the FIR was registered on 12.06.2025 and the case is at the initial stage of investigation, this Court is not inclined to grant anticipatory bail to the petitioners at this stage.
