ORDER

This writ petition has been filed seeking for a direction to the respondents to provide necessary police protection to the petitioner and the petitioner's family members for fencing and maintaining the land comprised in S.Nos.607/4, 607/5, 610/3A, 610/3C and 697 situated at Rajapuram Village, Aravakurichi Taluk in Karur District.

The learned counsel appearing for the petitioner submitted that the petitioner had earlier filed a civil suit in OS No.30 of 2019 for permanent injunction as against the proposed accused, before the learned District Munsif cum Judicial Magistrate, Aravakurichi and the same was decreed in favour of the petitioner as prayed for. Under such circumstances, it has become necessary for the petitioner, by the strength of the said decree, to put up fence around the subject property of this petition. In this regard, a representation has been given by the petitioner to the respondent police. However, no action was taken and hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that the enquiry pursuant to the petitioner's complaint is still pending. It was further submitted that the private respondents have instituted a 2/6

suit in O.S. No.27 of 2026 seeking a declaration, and that the said suit is also presently pending adjudication before the competent civil Court.

4. Heard the learned counsel on either sides and carefully perused the materials available on record. Since no adverse order is proposed to be passed against the private respondents, notice to them is dispensed with.

5. Considering the facts and circumstances of the case, the second respondent police is directed to issue notices to both the petitioner and the private respondents under Section 64 of the BNSS, conduct an enquiry, and conclude the same within a period of four weeks from the date of receipt of a copy of this order.

6. During enquiry, the petitioner is also directed to produce before the second respondent a copy of the decree obtained in his favour. Upon verification of the same, and subject to there being no legal impediment, the second respondent police shall provide appropriate police protection to the petitioner for the purpose of putting up a fence around the subject property, subject to payment of the requisite charges and in accordance with G.O.Ms. No. 139, Home (Pol-VIII) Department, dated 04.03.2019. 3/6
