For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Cr.No.135/2019 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under order 6(4) of TNSC (RDCS) order-1982 r/w Section 7(1) a (ii) of EC Act, 1955 in Crime No.135 of 2019, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that the petitioner has not committed any offence as https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.10997 of 2019 alleged by the prosecution and he has been falsely implicated in this case. The petitioner is not having any bad antecedent and hence, he prayed for grant of anticipatory bail to the petitioner. 4.Per contra, the learned Additional Public Prosecutor appearing for the respondent has submitted that totally there are three accused in this case. He further submitted that the petitioner is A3. He further submitted that A1 and A2 were arrested and remanded to judicial custody. He further submitted that the petitioner is having one previous case of similar in nature. Hence, he opposed this petition.

5.This is the second application. The previous petition in Crl.O.P.(MD).No.9366 of 2019 dated 03.07.2019 was dismissed by this Court on the ground that the petitioner is having one previous case of similar in nature and there is no change of circumstances in the present petition. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
