Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 2 to 5 to disburse the service benefits, including statutory deductions as per the pay slip issued by the Government of Tamil Nadu and other service dues of Late Dr.Rajapreethi (Employee No. 19031121276) and deposit the same in a nationalized bank in favour of her minor children, R.S.Dharaniyan and R.S.Dhinakaran, as per the valid nomination based on the petitioners representation dated 03.06.2025. The writ petition has been filed for issuance of a writ of mandamus, directing the respondents 2 to 5 to disburse the service benefits, including statutory deductions as per the pay slip issued by the Government of Tamil Nadu and other service dues of Late Dr.Rajapreethi 2/7

(Employee No. 19031121276) and deposit the same in a nationalized bank in favour of her minor children, R.S.Dharaniyan and R.S.Dhinakaran, as per the valid nomination based on the petitioner's representation dated 03.06.2025.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Having regard to the nature of the order proposed to be passed in this writ petition, notice to the sixth respondent is dispensed with.

3. The petitioner is a retired employee. His daughter, the late Dr. Rajapreethi, was married to the sixth respondent, and the couple had two minor children. Due to marital discord, Dr. Rajapreethi separated from the sixth respondent six years prior to her demise. The petitioner states that his daughter was employed as a Senior Resident in the Department of Obstetrics and Gynaecology at Theni Medical College. The petitioner's grievance is that the sixth respondent, a senior medical practitioner who operates a private multi-storied hospital in Madurai, is allegedly claiming the service benefits of his late daughter, in disregard 3/7

of the valid nomination made in favour of her minor children. Left with no other recourse, the petitioner has filed the present writ petition.

4. On the other hand, the learned Additional Government Pleader appearing on behalf of the respondents 1 to 5 would fairly submit that the third respondent will duly consider the case of the petitioner and appropriate orders will be passed, within a time frame as may be fixed by this Court.

In the light of the above submission, there shall be a direction to the third respondent to consider the case of the petitioner, on its own merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the third respondent to consider the same on its own merits.

6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
