: Respondents PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India for issuing a Writ of Mandamus, directing the respondents to include the petitioner name in the ensuing promotion panel for the post of Special Grade Municipal Commissioner 2019-20 on the basis of petitioner representation, dated 04.07.2019 and 27.07.2019 and consequently, direct the respondents to promote him to the post of Special Grade Municipal Commissioner on par his juniors.

Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that the respondent has passed an order, dated 05.08.2019 in Roc. No.4239/2018/C1 by rejecting the request of the petitioner to promote him as Special Grade Municipal Commissioner and hence, the relief sought for in this writ petition has become infructuous. W.P.(MD) No.16911 of 2019 seeks liberty to challenge the aforesaid order passed by the respondent.

2. Recording the aforesaid submission made by the learned counsel appearing for the writ petitioner, the instant writ petition is dismissed as infructuous with liberty is granted to the petitioner to challenge the order passed by the respondent, if so advised. No costs. Consequently, connected Miscellaneous Petition is closed.
