Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to disburse the educational loan of Rs.15,00,000/- to the petitioner's daughter P.S.Anila to pursue her studies within a time frame that may be stipulated by this Hon'ble Court by considering the representation of the petitioner dated 19.12.2016.

O R D E R

This writ petition has been filed, seeking to direct the respondent to sanction educational loan to his daughter namely, P.S.Anila, who is studying MBBS (Medicine) on the basis of his representation dated 19.12.2016.

2. Heard the learned counsel appearing on either side.

It is the case of the petitioner that he had submitted an application dated 01.07.2014 to the respondent along with relevant documents, requesting to sanction educational loan to his daughter namely, P.S.Anila, who is undergoing MBBS Course in China. It is the further case of the petitioner that the respondent bank, instead of issuing educational loan, sanctioned a minimum sum of Rs.6,00,000/- in the name of business loan. Subsequently, the petitioner's daughter submitted a representation dated 19.12.2016 to the respondent for sanction of educational loan in lieu of business loan and since there is no response on his representation, the petitioner is before this Court with the above prayer.

Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the matter, directs the respondent to consider the educational loan application / representation of the petitioner dated 19.12.2016 and pass appropriate orders thereon on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
