Writ Petition is filed under Article 226 of the Constitution of India, praying this Court .To issue a Writ of Mandamus to directing the respondents to bring the petitioners under the Tamil Nadu Pension Rules 1978 (Old Pension Scheme) by considering regularization of the petitioner in the post of Sweeper with effect from 20.12.2000 and to refund subscription already made by the petitioners towards new pension scheme within the time period For Petitioners : Mr.T.Lajapathi Roy For Respondents : Mr.D.Sadiq Raja, Additional Government Pleader.

ORDER

The Assistant Director of Town Panchayat, Tirunelveli Region, in compliance with the order passed by this Court in W.P. (MD)No.16486 of 2020 dated 20.11.2020, has submitted a proposal to the Director of Town Panchayat, who is the Head of the Department and who in turn, has to recommend the case to the Government for appropriate orders. Cont. P. (MD) No.1314/2021 considered the claim of the writ petitioner positively and forwarded the proposal to the Head of the Department. Thus, this Contempt Petition need not be kept pending. It is for the petitioners to pursue the matter further before the competent authority, who is competent to pass final orders.
