PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India to set aside the fair and decreetal order dated 05.04.2021 made in I.A.No.110 of 2020 in O.S.No.199 of 2018 on the file of the District Munsif Court, Pattukottai. For Petitioner : Mr.S.Prabhu

ORDER

The Civil Revision Petition has been filed to set aside the fair and decreetal order dated 05.04.2021 made in I.A.No.110 of 2020 in O.S.No.199 of 2018 on the file of the District Munsif Court, Pattukottai.

2.I.A.No.110 of 2020 was filed for amendment of plaint, which was allowed on costs. But, the petitioner has not paid the cost within the stipulated time and therefore, I.A.No.110 of 2020 was dismissed. Aggrieved over the same, the present civil revision petition has been filed.

3.This Court is of the view that the petitioner has to approach the District Munsif Court, Pattukkottai, for enlargement of time for payment of cost. Without exercising the remedy, the petitioner cannot file the present civil revision petition. Hence, this Civil Revision Petition is dismissed with liberty to the petitioner to file enlargement petition before the District Munsif Court, Pattukkottai. No costs. Consequently, connected Miscellaneous Petition is closed.
