ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to stop the laying of road inside the petitioner's property in S.No.24/2 to an extent of 0.45.00 Hectors respectively situated in Kodiyalam Village, Srirangam Taluk, Trichy District in accordance with law.

2. This Court through an interim order, directed the fourth respondent to survey and earmark the petitioner's land.

3. The learned Counsel appearing for the petitioner has produced a sketch showing that survey 24/2 belongs to the petitioner, Survey No.24/1A belongs to another person and Survey No.24/1B is a public pathway. He further submitted that there is a channel running through the pathway. Therefore, the petitioner is seeking to lay pipeline in the channel so that the water flow to the petitioner's land is not disturbed.

4. In view of the above, the respondents are directed to lay a proper pipeline wherever the channel crosses the road. The official respondents are permitted to lay the road in the available public pathway and if any portion of the proposed road extends beyond it, the official respondents are directed to acquire the land in accordance with law and thereafter, lay the road.

5. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs.
