O R D E R

[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner filed this Writ Petition to direct the respondents to remove the encroachment stated to have been made in respect of 40" Feet Road, Annai Indira Street, Sakthi Nagar, Thiruvanaikovil, Trichy - 5.

2. The alleged encroachers are not made as parties in this writ petition. We therefore do not find any ground to issue a Mandamus as prayed for by the petitioner. However, We make it clear that this order would not stand in the way of the respondents from taking action for removal of encroachment if any, after issuing notice to the encroachers.

3. The writ petition is disposed of with the above observation. No costs. Consequently, the connected Miscellaneous Petition is closed.
