ORDER

The petitioner has submitted a representation dated 27.05.2025 to the respondents, seeking permission to conduct "Bullock Cart Race" on 22.06.2025, during the celebration of "Tamilaga Vettri Kazhaga Thalapathy Vijay Birthday" at Pudur Union, Thoothukudi District. The said representation was rejected by the 3rd respondent, by his proceedings dated 09.06.2025. Challenging the same, the petitioner has filed this writ petition.

The learned counsel appearing for the petitioner submits that in the last week, the ruling party has made a similar request for conducting Rekla Race in the same area, which has been permitted by the respondent Police. On the other hand, when a request has been made by the petitioner, it has been rejected by the respondent Police. 2/6

3. The learned Additional Public Prosecutor has confirmed that in the last week, permission has been granted by the respondent Police to conduct Rekla Race in the same area.

Since the respondent Police has already granted permission for another political party in the same area, the respondent is not justified in rejecting the petitioner's representation by finding out the reasons. The reasons made out in the rejection application will also be applicable to other persons, who conducted Rekla Race in the last week. The respondent Police are not supposed to take any sides on political reasons.

5. This Court, by considering the directions issued by the Hon'ble Supreme Court in Transfer Petition (C) No.68 of 2013, is granting permission to conduct these type of events.

6. The learned counsel appearing for the petitioner submits that they will confine the Bullock Cart Race within two hours, i.e. from 6 a.m. to 8 a.m. on 22.06.2025.

In view of the above, this writ petition is disposed of, granting permission to the petitioner to conduct Bullock Cart Race on 22.06.2025 at Pudur Union, Thoothukudi District, from 6.00 a.m. to 8.00 a.m. However, the petitioner is supposed to conduct Bullock Cart Race without any disturbance to the persons, who are moving in the road. No costs.
