ORDER
The petitioner herein seeks a direction to the second respondent to conduct survey of the properties situated in Survey Nos.40/6B, 40/7A1 and 40/8, Madurai West Taluk, Vilacheri Village, Nagamalai Pudhukottai Firka.
2.Heard the arguments of M/s.S.Anusha, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the petitioner, he purchased the subject properties under three sale deeds dated 29.11.2001 and 20.11.2001. Subsequently, patta for the properties was also issued in his name in Patta No.3419.
Later, the petitioner submitted an online application on 27.05.2025 in Application No.2025/.0123/24/015861, seeking survey of the subject properties. The same has not been considered. Hence, the petitioner has come before this Court.
4.A perusal of the typed set of papers and the title documents circulated by the petitioner would suggest that he purchased the properties situated in Survey Nos. 40/6B, 40/7A1 and 40/4A1A2. However, the petitioner seeks survey of the property situated in Survey No.40/8 also. In the supporting documents submitted by the petitioner, there is no reference to Survey No.40/8. Therefore, this Court is not inclined to issue any directions to the respondents in respect of the property situated in Survey No.40/8. However, as far as Survey Nos. 40/6B and 40/7A1 are concerned, the petitioner has produced title documents and revenue documents in his favour. 5.Therefore, without expressing any opinion on the merits of the matter, the respondents 2 and 3 are directed to consider the online application of the petitioner dated 27.05.2025 and pass final orders on its
own merits insofar as 40/6B and 40/7A1 are concerned, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and other interested parties.
