PRAYER IN CRL RC(MD)No. 539 of 2017:

Pleased to allow this Criminal Revision petition and call for the records relating to order passed by the Learned Additional Sessions Judge, Karur in C.A.No. 30 of 2017 dated 03.04.2017 in partly allowing the Jdugment in C.C.NO. 142 of 2015 dated 07.11.2016 on the file of the Learned Judicial Magistrate, Fast Track Court at Magisterial Level, Karur and set aside the same. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.P.DHANASEKARAN, Advocate for the petitioner and of M/S.VILMA REXY, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed to cancel the order of bail, dated 14.07.2017 in Crl.M.P.(MD)No.6046 of 2017 in Crl.R.C.(MD)No.539 of 2017.

2.Earlier this Court by an order, dated 14.07.2017 in Crl.M.P. (MD)No.6046 of 2017 in Crl.R.C.(MD)No.539 of 2017 granted suspension of sentence to the respondent/accused on condition that the accused shall deposit a sum of Rs.1,00,000/- to the credit of Additional Sessions Court, Karur, within a period of six weeks from the date of receipt of a copy of that order and also directing to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) along with two sureties each for a likesum to the satisfaction of the learned https://www.mhc.tn.gov.in/judis 1/2

CRL MP(MD) No.7116 of 2019 Judicial Magistrate, Kulithalai with a further condition of the accused shall report before the Committal Court on the first working day of every English Calendar month at 10.30 a.m., till the disposal of the revision or until further orders.

3.The learned counsel appearing for the petitioner would submit that till date, the respondent/accused has not complied with the above condition imposed by this Court, dated 14.07.2017 in Crl.M.P. (MD)No.6046 of 2017 in Crl.R.C.(MD)No.539 of 2017. Hence, he prays to cancel the above said bail order, dated 14.07.2017. 4.The learned counsel for the respondent would submit that the respondent is ready to deposit Rs.1,00,000/- to the credit of Additional Sessions Court, Karur within ten days. 5.Taking into consideration of the submissions made by the learned counsel on either side, the respondent/accused is directed to deposit Rs.1,00,000/- to the credit of Additional Sessions Court, Karur on or before 09.12.2022.

6.With the above directions, this Criminal Miscellaneous Petition is disposed of.
